Whereas Sylvanus Castleman has this day given a power of attorney to Henry Elliott of St Genivieve Missouri to sell a lot of land in the common field of said Town—Now I do hereby agree to take the said lot of ground as a full compensation for surveying said castlemans land in Austin's Colony in the Province of Texas and for getting the title to said land, hereby giving him a receipt in full for all fees on said land—provided that if the title to said land be defective or incumbered this contract is to be void
